Public Records Request

FDC processes public records requests in accordance with Ch. 119 and s. 945.10, F.S. This includes the provision of cost estimates for production of records. The majority of the Department's public records must be reviewed for confidential and/or exempt information which will be redacted and produced with the applicable statutory exemptions. The preparation of records includes the review and redacting which occurs subsequent to receipt of payment. Generally, cost estimates can be minimized by greater specificity of the request.

Public records law does not require that an agency create records, give out information from their records, answer questions about their records, perform gratuitous research, reclassify their records into the manner requested, or produce records in a format other than that in which they are maintained.

Probation Records

Requests for an offender's probation record may be submitted to the appropriate office: Community Corrections

Medical Records

Pursuant to Ch. 33-401.701(10), F.A.C., requests for medical records of a current or former inmate must be specific, in writing, and accompanied by a properly executed Department of Corrections Release (form DC4-711B, DC4-711B-Spanish), or legally approved HIPAA compliant release form of another governmental agency.

Requests for medical records of released inmates shall be submitted to Inactive Medical Records:

Requests for medical records of current inmates shall be submitted to the Health Services Administrator at the institution housing the inmate.

In addition to an inmate's medical chart, their protected health information can appear within other records. Without the submittal of a properly executed DC4-711B any such information will be redacted from the requested record(s).
